Conditions of use:
By purchasing products from this website you agree to have accepted the following terms and conditions (Terms). Please take the time to read these carefully before placing your order. Chubb New Zealand may modify the Terms at its discretion from time to time without individual notice to you. You will be deemed to have accepted any modifications to the Terms if you continue to use this website after the modifications have been posted.

Terms and Conditions of Purchase

1.  Placing your order

1.1  All orders are subject to availability of stock.

1.2  Unfortunately we may not always be able to fulfil your online purchase due to stock shortfalls. In the event that your product is unavailable, we will try to order the product and deliver it to you when it becomes available. In this instance, there may be a shipping delay and you will be notified.

1.3  If your request cannot be filled, we will contact you on your nominated telephone number to discuss delivery times and / or alternative products. If you decide that you do not want to wait for delivery or receive alternative products, we will refund the purchase price to your credit card.

1.4  Chubb New Zealand (Chubb) reserves the right to refuse an order for any reason.

2.  Paying for your purchase

2.1  Chubb accepts Visa and MasterCard only. Your credit card will be charged when you proceed through the checkout process.

2.2  Prices listed and referred to on our website are in New Zealand dollars and are inclusive of GST.

2.3  Prices are subject to change without notice.

3.  Delivery

3.1  Delivery charges may vary depending on your delivery address and the nature of the purchase. These charges are displayed on the shipping page of this website (please click here to view) and are for single item purchases only. Additional items may incur a further fee per item.

3.2  Chubb will ship each order to one nominated Shipping Address only.

3.3  Chubb orders will be processed on the next business day.

3.4  All orders will be delivered using CouerierPost or Mainfreight within New Zealand and Registered International Service. It is recommended your preferred delivery address is a business address as all orders will be delivered during normal business hours.

3.5  Standard delivery times are up to 3 business days for orders within New Zealand major cities and 4 business days for regional areas. Chubb will make every effort to deliver your purchase on-time, however we will not be held responsible for any shipping delays which are out of our control.

3.6 Chubb does not accept any liability for products lost or damaged in transit.

4.  Returns

4.1  If you wish to return your purchase you may do so within 30 days of the order date.

4.2  All returns must be accompanied with a copy of your invoice email as proof of purchase.

4.3  Customers will assume all responsibility for returns, including shipping and handling. We recommend that you use a registered postal service for all returns. Chubb takes no responsibility for any damaged or lost goods.

4.4  Please follow these steps when returning products via post:

a) Please email Chubb.chd@chubb.co.nz with your original order number and details of the item you wish to receive in exchange or reason for returning your purchase;

b) Please wait for our reply email (we will respond within 3 business days) confirming your request;

c) Once you have received our confirmation email, please check that the product/s being returned are in their original condition and in their original packaging. Enclose a copy of your original invoice email in the package;

d) Send the product/s back to Chubb at our return address - Chubb New Zealand (RETURNS) 3 Fisher Crescent, Mt Wellington, Auckland; and

e) Once we receive your parcel we will fulfil your request. All justified claims for refunds will be processed within 1 to 5 business days after receiving the goods.

4.5  We will happily refund you the cost of the product if you change your mind, however any associated delivery costs (including a 10% restocking fee) may apply.

4.6  The cost of all returns will be borne by the customer.

4.7  Refunds will only be processed on the credit card used to make the original purchase.

5.  Faulty Products

5.1 If you believe the product you purchased from Chubb is faulty, you may return the product via post by following the steps listed above.

5.2  Chubb does not guarantee that your claim for faulty products will be accepted. We will need to assess the product first and if your claim is warranted, the product will be repaired, replaced or refunded. Any costs incurred in returning the faulty product via post will be reimbursed on presentation of a postal receipt.

5.3  You must provide proof of purchase for any claim of faulty products.

6.  Liability

6.1  This website follows the Model Code for Consumer Protection in Electronic Commerce and the Consumer Guarantees Act 1993. These are both available at www.consumeraffairs.govt.nz. CNZ also observe our obligations as set out by the Fair Trading Act 1986, which can be accessed at www.comcom.govt.nz.

6.2  Where the provisions of the Consumer Guarantees Act 1993 (Act) apply, these Terms will be read subject to the application of that Act, and in the case of any conflict, the provisions of that Act will apply.  The Act does not apply to business customers purchasing products for the purposes of a business (where 'business' is as defined by the Act). Business customers agree that where products are purchased for the purpose of a business that the Act does not apply.

6.3  Chubb provides this website and its contents on an "as is" basis, and makes no representation or warranty as to the accuracy, completeness, currency or reliability of the information contained on this website (including in relation to any products). To the extent permitted by law, Chubb expressly disclaims all warranties of any kind, whether express or implied, including without limitation implied warranties  or conditions of merchantability or suitability for a particular purpose. Chubb will not be liable in contract, tort (including negligence) or otherwise to you for any direct, special, indirect or consequential loss or damage (including loss of profits or loss of data) arising out of or in connection with this website, or products supplied by Chubb via this website. Chubb's total liability to you (if any) in connection with this website, these Terms or any order of products will be limited, at our election to: (1) in the case of information or services supplied or offered by us, the re-supply of the information or services or payment of  the cost of doing this; (2) in the case of products supplied or offered by us, repair or replacement of the products, supply of equivalent products, or payment of the cost of doing this; and/or (3) the amount paid by you (if any).

7.  Privacy

7.1 We will comply with our Privacy Policy and you accept this Policy as governing our use of the personal information we receive about you.

8.  General

8.1 Entire Agreement: These Terms contain all of the terms, representations and warranties made between us covering the subject matter of these Terms.

8.2 Amendments: Except as otherwise expressly provided in these Terms, no amendment of these Terms will be effective unless it is in writing and signed by both of us.

8.3 Waiver: No waiver by us of any breach of these Terms will be considered as a waiver of any subsequent breach of the same or any other provision, and no waiver will be binding on us unless it is given in writing.

8.4 Severability: Any provision of these Terms that is illegal, void or unenforceable will not form part of these Terms to the extent of that illegality, voidness or unenforceability. The remaining provisions of these Terms will not be invalidated by an illegal, void or unenforceable provision.

8.5 Interpretation: If any provision of these Terms is ambiguous or open to interpretation, we will in our absolute discretion, determine the interpretation of the relevant provision.

8.6 Assignment: We may assign the benefit of these Terms to any party without obtaining your consent.

8.7 Governing Law: These Terms will be construed and take effect as a contract made in New Zealand and will be governed by New Zealand law, and we each submit to the non-exclusive jurisdiction of the New Zealand courts.
